PITTSFIELD -- A former nursing home employee acc used of attempting to rape a resident was arraigned on Tuesday in Berkshire Superior Court and remains under house arrest pending the outcome of his case.
Paul Shartrand, 46, of Pitts field, pleaded not guilty to single counts of assault with the intent to commit rape, caretaker abuse on a disabled person, and assault and battery on a disabled person.
According to police and prosecutors, Shartrand, while emp loyed as a certified nursing assistant at the Laurel Lake Center for Health and Rehab ilitation in Lee, sexually assaulted a 55-year-old disabled woman in August. Shartrand is no longer employed by the nursing home.
Shartrand was arrested by Lee Police after another employee entered the room and reported the incident. The alleged victim was in the late stages of Huntington’s disease and unable to communicate.
Shartrand denied the allegations and told police the employee who accused him of the crime "was out to get him."
On Tuesday, Judge John A. Agostini maintained Shart rand’s $5,000 bail, his house arrest and his monitoring by a GPS tracking device. Those were the same conditions set when Shartrand was arraigned at the district court level.
Shartrand is only permitted to leave his home to attend church with a family member, go to medical appointments, meet with his lawyer and attend court.
The case is being prosecuted by Assistant
A pretrial hearing is scheduled for March 25, 2013.
