PITTSFIELD -- A 52-year-old city man pleaded guilty Thursday to the sexual assault of a woman he had bailed out of jail and was sentenced to the time he has served awaiting the outcome of the case, about a year and two months.

Larry Jones of Church Street has been in jail on $50,000 bail bond since his arrest on Dec. 31, 2011. That night, the Pittsfield Police responded to a home where a 39-year-old woman told police that Jones, an acquaintance, had bailed her out of jail earlier that day.

After the woman was released, the two drank alcohol together and she later awoke from a nap to discover Jones on top of her and touching her, according to the Berkshire District Attorney's Office.

Originally charged with rape, Jones pleaded to the lesser offense of indecent assault and battery on a person over 14 as part of a plea deal between the DA's office and Jones' lawyer, Jill Sheldon.

As part of the deal, Jones will not have to register as a sex offender. According to Assistant Berkshire District Attorney Gregory Barry, the victim was in agreement with the resolution of the case.

Thursday in Berkshire Superior Court, Judge John A. Agostini sentenced Jones to 418 days at the Berkshire County Jail & House of Correction -- time served -- in line with the agreement.

The maximum sentence for the crime is five years in prison or 21 2 years in the county jail.
