The facts in the Governor’s Council’s inexplicable vote against attorney Michael McCarthy are these:
Attorney McCarthy never said he would help the prosecution. He acknowledged the questioner’s observation that judges have the ability to drop hints, and then his answer was this: "The Commonwealth has the burden and the judge cannot suddenly try the case for the commonwealth." He stated clearly that the judge should avoid any such meddling. Any statements by councilors to the contrary are simply not accurate.

A response from another letter to the editor regarding attorney McCarthy’s nomination says it best. "It’s unthinkable to suggest that seven highly regarded sitting judges, including a justice of the Massachusetts Supreme Judicial Court, and the current district attorney, would jeopardize their reputations and their standing in the community, to give testimony on behalf of a nominee whom they believed in their hearts to be a less than qualified candidate for a position on the bench."
Attorney McCarthy is an excellent lawyer with a long and distinguished career and he should be a sitting judge today. He has the respect and the support of the judiciary
This Governor’s Council has twisted the facts, and the local media has failed to report the facts. It appears that these Boston politicians have a hidden agenda, and attorney McCarthy was not part of that agenda.
This process has been an insult to the governor, attorney McCarthy, the Berkshires, and all citizens of Massachusetts.
