PITTSFIELD >> The breaking and entering case against Craig Gaetani is moving forward.

Gaetani, a one-time Pittsfield mayoral candidate, was arraigned in Central Berkshire District Court on Tuesday on a charge of breaking and entering into a motor vehicle with the intent to commit a felony.

Judge Paul Smyth denied a request for an immediate motion to dismiss the case against Gaetani, who claimed he is the rightful owner of the vehicle in question.

Smyth told Gaetani the arraignment phase was not the place to discuss a motion to dismiss, especially when the state had not yet been informed of his intention to file such a motion.

He entered a not guilty plea to the charge and a pretrial hearing date of Sept. 21 was set.

Gaetani has another open criminal matter, having been accused of threatening to shoot a municipal employee during a series of harassing phone calls last year.

That case is scheduled for trial in December.
