PITTSFIELD -- A man police say launched a wine bottle at a customer in an altercation at a liquor store this summer was sentenced to 15 months in jail.

District Court Judge Fredric D. Rutberg labeled 30-year-old Fabien Hernandez, of Columbus Avenue, "a criminal" before sentencing him to serve his sentence at the Berkshire County Jail & House of Correction. Hernandez pleaded guilty on Monday in Central Berkshire District Court to felony vandalism and three counts of assault and battery.

According to police and prosecutors, Hernandez on Aug. 14 was at the counter of K&K Liquors on North Street in Pittsfield when another customer bumped into him. An argument ensued and turned physical. Hernandez picked up a wine bottle and threw it at the man. The bottle missed its intended target and shattered the glass door of a cooler that cost about $1,000 to replace. Both Hernandez and the other man left the shop.

The next month, on Sept. 16, Hernandez choked and slapped his girlfriend during an early morning argument and then returned to the scene two hours later and punched a 23-year-old female neighbor in the face when the woman tried to intervene, according to a Pittsfield Police report.

The blow split the woman's right eyebrow. She was taken to Berkshire Medical Center where she received stitches, police said.

Hernandez was additionally charged with assault and battery for pushing a third woman during the incident.

Assistant Berkshire District Attorney Jason Lederman told the court on Monday that the defendant had "an extensive" criminal record and a dozen restraining orders involving five different women. He asked for an 18-month jail sentence for the defendant.

Hernandez's lawyer, Jerrold F. Trehey, said his client had a drinking problem and was very sorry for his behavior. He asked that Hernandez be given a year in jail on all counts.

The judge sentenced Hernandez to a total of 15 months and ordered that he be allowed to attend an in-house alcohol rehabilitation program.
