GREAT BARRINGTON -- A Chicopee man originally charged with attempted murder will be facing a lesser charge following a court hearing on Thursday at Southern Berkshire District Court.
Hector Isales Cruz, 53, is facing a total of five charges related to an alleged New Year's night assault during which he attacked the son of his ex-girlfriend with a 15-pound dumbbell. He was allegedly upset because he was kept waiting for a drive home.
Cruz told police he was attacked first and he denied knowing about the use of a dumbbell, which was found on the scene, according to court records.
Cruz was invited by his ex-girlfriend to stay over at her home on State Road in Great Barrington for the Christmas and New Year's holiday, according to a statement from Great Barrington patrolman Richard Keefner.
His girlfriend said Cruz grew increasingly agitated to the point where he stopped talking to her during the extended stay, according to the police account. The police account did not say why.
On New Year's Day around 2 a.m., Cruz was expecting to be driven home, but he was kept waiting in the parking lot. He allegedly stormed up to his ex-girlfriend's place on State Road, and her son answered the door.
Cruz allegedly told him, "You're not going to take me! I'm going to kill you!"
Cruz allegedly had a dumbbell in hand, and he swung it at her ex-girlfriend's son. The two fought, and the dumbbell was removed from his hand. Then Cruz went and grabbed a knife from the kitchen, which he used as a weapon until two males were able to remove it from his hand.
Following the fight, the ex-girlfriend's son was taken to the hospital because he was bleeding on his his left side.
Both Sheffield and Great Barrington police responded, according to the police account.
Cruz is facing charges that include two counts of assault and battery with a dangerous weapon, destruction of property, and assault and battery.
His case is next scheduled for court on Feb. 13.
