PITTSFIELD -- A homeless man originally from New York City is being held on $10,000 cash bail for allegedly beating his ex-girlfriend after she refused to let him stay at her house.
Walter A. Bynum, 48, punched the woman in the face on Sunday night as she was making her way into her Stoddard Avenue home and then pushed her, causing her to strike her face on the porch railing, according to Pittsfield Police. The woman, 45, said she had just denied a request by Bynum, her ex-boyfriend, to stay at her house.
Bynum ran off when one of the woman's teenage sons chased him down the street after the teen heard his mother scream.
The woman was taken to Berkshire Medical Center, where she was treated for her facial injuries and released. She was granted a restraining order against Bynum.
The defendant was arrested Monday afternoon at the bus station in Pittsfield. He told police he was planning on going back to New York City, according to Assistant Berkshire District Attorney Michael D'Angelo.
Bynum, through his attorney Jerrold F. Trehey, told a different version of events. He told police he was invited to the house and once there, he was confronted over allegations that he had been seeing someone else. Trehey said his client was attacked first.
Trehey said his client didn't have a Massachusetts record and although he did have a record in New York, he always showed up for court. The attorney asked that his client be released on personal recognizance.
The prosecutor said while Bynum didn't have a record in Massachusetts, he had an extensive criminal history in New York. He cited this, the nature of the allegations, and the fact Bynum was allegedly trying to flee the jurisdiction as reasons for $10,000 cash bail.
Bynum pleaded not guilty in Central Berkshire District Court on Tuesday to a single count of misdemeanor assault and battery.
Judge Charles W. Groce III pointed to Bynum's 23 page criminal record that went back 25 years when sending the defendant to the Berkshire County Jail & House of Corrections in lieu of $10,000 cash bail.
Bynum is due back in court on April 1 for a pretrial hearing.
