Boston teen admits to killing 9-year-old brother

BOSTON (AP) -- A 15-year-old Boston boy has pleaded guilty to fatally shooting his 9-year-old brother and been ordered into the custody of state Department of Youth Services until he is 21.

Juanly Pena, who was 14 when he accidentally shot Janmarcos Pena in their apartment in February pleaded guilty to manslaughter and unlawful possession of a firearm as a youthful offender Wednesday in juvenile court.

He was sentenced to three years in prison, which will be suspended if he stays out of further legal trouble and abides by certain conditions, including getting a high school diploma or employment. If he violates those conditions he must serve the entire sentence.

Prosecutors say he thought the gun was unloaded when he pointed it at his brother’s heart.

His lawyer described his client as scared.
