Hinsdale caretaker charged with abusing elderly man, leaving him with broken ribs

PITTSFIELD — A 52-year-old Hinsdale man has been charged with assaulting an 84-year-old man in his care, leaving him with a pair of fractured ribs.

Anthony M. Marcella II, was arraigned in Central Berkshire District Court on July 3 and entered not-guilty pleas to charges of assault and battery on a person over 60 or disabled with serious injury, assault and battery on a person over 60 or disabled, witness intimidation, caretaker abuse of an elder and caretaker abuse of an elder causing serious bodily injury.

The assault and resulting injuries are believed to have occurred on May 22 or 23.

Hinsdale police began their investigation into the claims on June 12, following a report from Elder Protective Services.

According to court records, the victim had been transported to Berkshire Medical Center on May 26 amid complaints of difficulty breathing.

The victim said Marcella was "rough" when trying to pick him up after a fall and squeezed him in an aggressive manner.

He described the treatment as, "being thrown around like a rag doll," and a medical exam showed he had two fractured ribs.

Following his arraignment, Marcella was held for a dangerousness hearing on July 5 before Judge Jacklyn Connly.

Following that hearing, a bail of $1,000 was set for Marcella, which was posted. He is due back in court on Aug. 7 for a pretrial hearing.

Marcella was convicted in 2013 on charges of vandalizing property and malicious destruction of property over $250 after leaving threatening and offensive messages regarding a particular woman throughout October State Forest between 2010 and 2011.

He was sentenced to nine months in jail.
