Judge: Investor deceptively avoided paying man for his home
BOSTON >> A Boston judge has ruled in favor of a formerly homeless man who claimed that an investor bought his Brighton home in 1997 and then failed to pay him.
The Boston Globe reports that Judge Mary Ames ruled last week that Brian Burke and his lawyer used deception to avoid paying 75-year-old John Wenk.
The MIT graduate claimed he only received the $10,000 down payment for the home.
Wenk remained homeless after the sale until moving into senior housing around 2002.
Ames says the record suggests Burke and his attorney intentionally failed to alert Wenk to a lawsuit that would let Burke avoid paying most of what he promised.
Wenk's lawyers say they'll move to foreclose on the property assessed at $1.34 million.
Burke says he plans to appeal.
