Pittsfield driver faces his fourth OUI

PITTSFIELD -- A 47-year-old who is charged with his fourth drunken driving charge is being held on $1,000 bail following his arraignment on Monday in Central Berkshire District Court.

Phillip Donati, 47, of Pittsfield, was pulled over by city police on Saturday night around 10 after another driver reported to 911 that a blue Saturn was "all over the road."

Donati was pulled over on West Street near Valentine Road. Accor ding to a Pittsfield Police report, he smelled of alcohol, was unsteady on his feet and had slurred speech.

Donati was charged with fourth-offense drunken driving, a felony that carries a minimum mandatory of a year in jail, and was also charged with driving with a revoked license -- allegedly for being a habitual traffic offender -- and driving on a suspended license stemming from drunken driving.

On Monday, Donati pleaded not guilty to the charges. Judge Michael Mulcahy ordered him to be held on $1,000 bail. If the defendant makes bail, he must refrain from drinking, doing drugs and driving and must report to probation as required, according to the judge's ruling.

Donati was still in custody as of Monday afternoon. He is scheduled to be back in court for a pretrial hearing on Nov. 28.

The police report did not list the dates of Donati's previous drunken driving convictions.

Donati has two pending cases as well. In June, he was charged by Lanes borough Police with driving on a suspended license and speeding. He is also facing two counts of assault and battery for allegedly attacking two former tenants at the Salvation Army in Pittsfield in November 2011. He is scheduled to go to trial in that case next month. Attorney John A. Bernardo is representing him on all his cases.
