Pittsfield man charged after allegedly defecating on a neighbor's lawn
PITTSFIELD -- A 56-year-old man, who was recently in the news for an alleged machete and crowbar fight with his brother, is now facing a charge of open and gross lewdness for defecating on a neighbor’s lawn, according to police.
Paul Kwasniowski of Williamsburg Terrace is scheduled to be arraigned on his newest charge on Tuesday. The Pittsfield Police Department filed the charge on Friday. Paul Kwasniowski was not arrested, but will be summonsed into Central Berkshire District Court to face the accusation.
According to a probable cause report, a witness told police he was looking out his kitchen window on Nov. 9 and saw Kwasniowski glance around before pulling down his pants along the tree line of a neighbor’s property on Cheshire Road, around the corner from where Kwasniowski lives.
"I just couldn’t believe it," the witness told police.
According to police, Kwasniowski told the officers he had only left his home that day to take the garbage to the curb, that he was involved in a "long-standing feud" with his neighbors and that they were "out to get him."
Police said they located a pile of human waste on the alleged victim’s lawn.
A little more than a week before this alleged incident, a felony charge of assault and battery with a dangerous weapon had been dismissed against Kwasniowski in regard to an alleged crowbar and machete fight with his brother, 61-year-old John Kwasniowski, in May 2011. This dismissal came after Paul and John refused to testify against each other because they could incriminate themselves.
John Kwasniowski pleaded to facts sufficient for a finding of guilt and had his case continued without a finding of guilt for three months. He returned to Las Vegas where he resides.
The dispute over a home the brothers co-owned sparked the fight that left Paul with a number of injuries, including a broken wrist, fingers and nose, as well as a large gash to the head, for which he was hospitalized for several days, police said.
In 2009, Paul Kwasniowski made an unsuccessful bid for Pittsfield mayor.
A call to his home was not immediately returned.
