Separate trials ordered for Pittsfield couple in rape case
PITTSFIELD -- Separate trials will be held soon for a Pittsfield man accused of raping a teenager and for the man's wife, who police allege knew about the abuse but didn't report it.
Jason Bushey, 32, of Pittsfield, allegedly sexually assaulted the girl at the couple's house on different occasions between Feb. 1, 2011, and Oct. 31, 2011. He later intimidated the young woman, who is now 19, according to police.
He is charged with multiple counts of rape and indecent assault and battery on a person 14 or older, and a single count of witness intimidation. He denies the charges.
Prosecutors say Crystal Bushey was aware of what was going on, but didn't tell authorities. She has denied a single count of reckless endangerment of a child.
On Wednesday in Berkshire Superior Court, attorneys in the case asked the court to sever the cases from one another. No reason was given in open court, but it was allowed because it was agreed by all the parties.
Jason Bushey's trial will be first and may start as early as next Tuesday. Crystal Bushey's case will follow that of her husband.
Judge Daniel A. Ford asked if any offers had been made in the case.
Assistant Berkshire District Attorney Rachael Eramo said she hadn't made any offers, believing that the defense was intent on taking the cases to trial.
Attorney Nathaniel K. Green, who represents Jason Bushey, said a trial was likely, but that he would discuss a possible deal with the prosecutor.
David Pixley, Crystal Bushey's lawyer, said he had presented a standing offer to the DA's Office of a continuation without a finding of guilt for his client. It appears that case will also be going to trial.
The investigation into the alleged crimes was conducted by members of the Pittsfield Police Department.
