Trial set for NY man in crash that killed Housatonic woman

GREAT BARRINGTON — A jury-of-six trial will be held next month for a New York City man charged in a head-on car crash last year that killed a Housatonic woman.

Robert Bacigalupi, 69, is scheduled to be tried July 24 in Central Berkshire District Court on charges of motor vehicle homicide and a marked-lanes violation. The trial date was set last month by Judge William Rota in Southern Berkshire District Court.

Bacigalupi told police he had been traveling eastbound on Maple Avenue (Route 23) from his second home in Hillsdale, N.Y., on April 14, 2018, when he crossed the center line and struck a car being driven by Annemarie Bushka, according court documents.

Bushka, 64, died of her injuries at the scene. The force of the accident caused Bacigalupi's car to flip. He was treated at Berkshire Medical Center. At the time, police said his injuries were not believed to be life-threatening.

Bacigalupi, an attorney for two nonprofits, attributes the accident to his possibly having "passed out" from a "mini stroke" due to a seizure disorder that he claims he was unaware of, according to court documents.

Documents say that he had been diagnosed in 2010 with "episodic memory loss" as well as the seizure disorder, and that he had no recollection of the accident.

His attorney, Lori Levinson, told The Eagle the same.

"He was suddenly upside down in his car — he had no idea how he got there," she said.

Bushka, an advocate for senior citizens who also had worked as an attorney, later worked at the Great Barrington Senior Center as assistant to the director.
